These Terms of Service ("Terms") govern your access to and use of the website bjsdsolutions.com and all applications, services, and products provided by BJSD Solutions, LLC ("we," "our," or "us"), including but not limited to TextSwapper, BJSD Hub, RaceRuler, and any other applications we may offer (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

2. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations

• Infringe upon the rights of others

• Transmit any harmful code or malicious software

• Attempt to gain unauthorized access to our systems

• Interfere with or disrupt the Services

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying structure of our Services

• Copy, modify, or create derivative works based on our Services or any portion thereof without our express written permission

3. Security Monitoring and Audit Logging

By using our services, you acknowledge and agree that:

3.3 Data Retention

3.4 No Expectation of Privacy

You acknowledge that IP addresses and request metadata are essential for security operations and are logged automatically. This logging is necessary for the security and integrity of our services.

4. Account Registration

To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Intellectual Property

The Services and their original content, features, and functionality are owned by BJSD Solutions, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying structure of our Services. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

6. Payment Terms

6.1 Payment Processing

All purchases are processed securely through Stripe, our payment processing service provider. By making a purchase, you agree to Stripe's Terms of Service (https://stripe.com/legal/ssa).

6.2 Payment Methods

We accept all major credit cards, debit cards, and other payment methods supported by Stripe Checkout, including Apple Pay, Google Pay, and Link.

6.3 Currency

All prices are displayed in USD (United States Dollars) unless otherwise stated.

6.4 Payment Authorization

By providing a payment method, you authorize us to charge the payment method for the amount specified at the time of purchase.

6.5 Failed Payments

If a payment fails, your purchase will not be completed. We are not responsible for any fees charged by your financial institution for failed or declined transactions.

7. Refund Policy

7.1 License Purchases

All license purchases are final and non-refundable unless required by law or as otherwise stated below.

7.2 Refund Eligibility

Refunds may be issued in the following circumstances:

• Duplicate charges due to technical errors

• Unauthorized transactions (subject to verification)

• As required by applicable consumer protection laws

7.3 Refund Process

To request a refund, please contact us at support@bjsdsolutions.com with your order details and reason for the refund request. Refunds, if approved, will be processed to the original payment method within 5-10 business days.

7.4 Chargebacks

If you dispute a charge with your payment provider, we reserve the right to suspend or terminate your account and licenses until the dispute is resolved. We encourage you to contact us first at support@bjsdsolutions.com to resolve any billing issues before initiating a chargeback.

8. Trial Period Terms

8.1 Free Trial

We may offer free trial periods for certain products. During the trial period, you will have full access to all features of the product.

8.2 Payment Method Required

To start a free trial, you must provide a valid payment method. Your payment method will not be charged until the trial period ends.

8.3 Automatic Conversion

At the end of the trial period, if you have not cancelled, your payment method will be automatically charged for the full license price. The license will remain active as long as the payment is successful.

8.4 Cancellation

You may cancel your trial at any time before the trial period ends through your account dashboard or by contacting us at support@bjsdsolutions.com. If you cancel before the trial ends, you will not be charged.

8.5 Failed Payment

If payment fails at the end of the trial period, your trial access will be terminated and you will lose access to the service.

9. License Terms

9.1 License Type

Licenses purchased through our Services are lifetime licenses for the purchased version of the software, unless otherwise stated.

9.2 License Transfer

Licenses are non-transferable and may only be used by the account holder who purchased the license.

9.3 Device Limits

Each license includes a specific device limit as stated at the time of purchase. Exceeding the device limit may result in license suspension or termination.

9.4 License Revocation

We reserve the right to revoke licenses in cases of:

• Violation of these Terms of Service

• Fraudulent payment activity

• Chargebacks or payment disputes

• Unauthorized use or distribution of the software

10. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, BJSD Solutions, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
